Dear Friends and Supporters,

We're going to trial with the FBI! October 1, 2001 is the date. And we're working our buns off to get ready. The stress is phenomenal. The deadlines are piling on top of us. The workload is unbelievable — but we're doing it. Expert witness statements, last rounds of depositions, interrogatories and requests for admissions, even searching for a new office space close to the Oakland courthouse — that's the work at hand. We're also preparing a final "Motion for Justice" to bring Special-Agent-in-Charge Richard Held back into this case, something we've been wanting to do ever since the judge dismissed him. It's exciting, exhilarating, and exhausting. Thanks for being with us on this long road.

We've got a number of dates we'd like you to be aware of. Hopefully you can come and support us at some of our upcoming rallies, benefits and court appearances.

Thursday, May 24, 12 Noon — Federal Courthouse in Oakland, 1301 Clay Street (and 12th). Rally at the site of the upcoming trial and commemorate the life of Judi Bari on the 11th anniversary of the bombing. Speakers and musicians will include attorneys Dennis Cunningham and Tony Serra (schedule permitting), plus Julia Butterfly, Utah Phillips, Darryl Cherney, Alicia Littletree, Lisa Bari and others. Bring your fiddles, other instruments, posters and costumes.

Thursday, May 24, 8 PM — Benefit concert for the lawsuit with Clan Dyken, Joanne Rand, Matt Eakle (flutist with the David Grisman Quintet), Utah Phillips, Alicia Littletree and Darryl Cherney. Unitarian Church at Cedar and Bonita, Berkeley. Sliding scale $10-15 donation at the door. 

Sunday, June 3, 12 Noon — Mass Rally for the Mattole Forest in Humboldt County. Earth First! is still staging rallies and actions in the spirit of Judi Bari. We'll be gathering at the gate to a 4,000acre stand of ancient Douglas fir "owned" by MAXXAM/ Pacific Lumber. There have already been dozens of arrests. Activists have been hit with a SLAPP lawsuit by Pacific Lumber. This lawful rally for adults and children of all ages will allow us to stand up in solidarity with our comrades who are sitting in trees and blockading bulldozers, just like we did in Redwood Summer 1990. Friday, July 27, 10 AM — Final pretrial hearing on the merits of the case in Judge Claudia Wilken's Courtroom, 1301 Clay Street, Oakland (call 707/923-4949 to confirm). A flurry of last minute motions will make this day in court one not to miss. The FBI is expected to make one last attempt to have the case thrown out or delayed. We've survived ten years of these motions and expect we will prevail. Our attorneys, including Dennis Cunningham and Tony Serra, will ask the court to allow our entire claim to go to trial by restoring the FBI "Chain of Command" defendants who were previously dismissed. This will be the big prelude before the October 1 six-week trial begins. We'll be contacting you again before that date to keep you posted.

Almost all the people working on this case were very close to Judi Bari and knew her for years. We continue to carry her torch. What a weight it is to bear! Without Judi here for the last four years, we've all had to work double-time to make up for the loss of her incredible strategic analysis and ability to work tirelessly. Allow us to share just one example of the kind of incredibly heroic woman Judi was. Two months before she died, not only was Judi making final arrangements for her two daughters to be cared for, but she was busy summarizing hundreds of pages of depositions taken from FBI agents and Oakland Police officers! The dates of her work stands at the top of each page — a reminder of how committed this remarkable woman was in the very last days of her life as she succumbed to cancer.

We would appreciate it if you could help out with a donation as we come down the home stretch. The depositions alone can cost $1000 each and we've got about 15 more we've still got to take. The Oakland office near the courthouse won't be cheap, even for the few months we rent it. Expert witnesses cost a pretty penny as well — bomb experts, nail experts, FBI false informant experts, the list goes on. We're counting on you to pull us through this.

Judi Bari didn't work on this case for herself. She did it so that all of us could have a bit more justice in this country. Judi wanted to hand over to us the most organized lawsuit in the world so it would be possible for us to carry on. And what a job she did. And carry it on we do.
